Terms of service
These Terms govern access to caribis.us and purchases from Caribis. Separate written terms for a custom or made-to- measure order may supplement these Terms and will control for that order if they expressly differ. Nothing in these Terms limits mandatory consumer rights that cannot lawfully be excluded.
1. Overview and Acceptance
This website is operated by Caribis. Throughout the website, the terms “Caribis,” “we,” “us,” and “our” refer to Caribis. We provide this website, its content, tools, products, and related services subject to these Terms of Service and the policies referenced in them.
By visiting the website, creating an account, placing an order, paying a deposit, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the website or place an order.
2. Shopify Platform and Website Availability
Our online store is hosted on Shopify Inc., which provides the e-commerce platform used to display products and process website orders. Shopify and other service providers may have their own terms and privacy practices.
We may update, suspend, restrict, or discontinue any part of the website or service when reasonably necessary. We do not guarantee uninterrupted or error-free access, but we will not use this clause to remove rights that apply to an accepted order.
3. Eligibility and Lawful Use
You must have legal capacity to enter into a purchase contract in your place of residence. Where required, a parent or legal guardian must place or approve an order on behalf of a minor.
You may not use the website, our products, or our services for any unlawful, fraudulent, abusive, or unauthorized purpose, or introduce malicious code, interfere with security, scrape the website without permission, or infringe the rights of Caribis or any third party.
4. Products, Images, Colors, and Availability
We make reasonable efforts to describe and photograph every product accurately. Because screens, lighting, dye lots, natural fibers, handwork, embroidery, lace placement, and small-batch production may vary, the delivered item may show minor differences from photographs or samples that do not materially change the approved design.
Products, fabrics, trims, and services may be limited, changed, or discontinued. If an approved material becomes unavailable, we will contact you to agree on a suitable alternative or another appropriate solution.
The product page, order confirmation, invoice, or written agreement will identify the applicable order type. A separate Custom Order or Wedding Dress Order Terms document may also apply.
5. Order Types

Caribis may offer the following order types:
Ready-to-ship items: existing pieces available for dispatch after full payment. - Standard-size made-to-order items: pieces produced in a listed size without individual pattern change

Custom or made-to-measure items: garments created, altered, personalized, or produced according to individual measurements, design choices, non-standard colors, fabrics, lengths, embroidery, or construction details.
6. Order Placement and Acceptance
Submitting an order is an offer to purchase. We may verify product availability, measurements, timing, payment, shipping details, and order legitimacy before acceptance. An order is accepted when we send confirmation, confirm the custom order in writing, or begin fulfillment or production.
We may decline or cancel an order before acceptance, or where there is a pricing error, suspected fraud, unavailable material, impossible deadline, restricted destination, or other reasonable operational issue. If we cancel an order after receiving payment and no non-refundable custom work has begun, we will refund the applicable amount to the original payment method.
7. Prices, Currency, and Payment Methods
Unless expressly stated otherwise, prices on caribis.us are shown and processed in U.S. dollars (USD). A bank or payment provider may apply exchange rates, conversion fees, or foreign transaction fees.
Available payment methods may include major credit or debit cards and PayPal through website checkout. Bank transfer may be arranged when needed for a custom, high-value, or specially agreed order. Bank details are provided only after the customer contacts Caribis and the payment arrangement is confirmed.
A payment is considered complete only after successful authorization and receipt or confirmation of funds. We may request reasonable verification for security or fraud prevention.
8. Deposits and Remaining Balance
Custom and made-to-order work generally requires a 50% deposit to confirm the order, reserve production capacity, and begin design, sourcing, pattern work, or sewing. A different deposit may apply if expressly stated in the product listing, invoice, or written agreement.
The remaining balance is due after Caribis sends final photographs or otherwise confirms completion and before dispatch. We will not ship the garment until the full balance and any approved additional charges have been paid.
Once work has begun, materials have been ordered or reserved, or order-specific costs have been incurred, the deposit is non-refundable except where required by applicable law or where Caribis agrees otherwise in writing.
9. Custom Orders, Measurements, and Approvals
For custom or made-to-measure orders, the customer must provide complete and accurate measurements using the Caribis instructions, wear the recommended undergarments when measuring, and promptly confirm design, fabric, color, embroidery, and construction details.
Caribis is not responsible for fit issues caused by inaccurate measurements, changes in the customer’s body after measurements are submitted, failure to follow measuring instructions, or alterations made by another person. Where a fit issue is caused by a confirmed Caribis production error, we will provide an appropriate correction or other remedy.
The customer must review sketches, samples, progress photographs, and approval requests carefully. Approval authorizes Caribis to continue to the next production stage.
10. Production Time and Rush Orders
Production time is separate from shipping time. Most made-to-order garments require approximately 4-6 weeks, while complex custom pieces, extensive hand embroidery, special materials, or multiple approvals may require longer. The product page or written order confirmation will provide the applicable estimate.
Please provide the required delivery or event date before ordering or in the order notes. We may be able to produce an order faster when needed, but rush production must be confirmed directly with Caribis before purchase or before work begins. Rush availability depends on atelier capacity, material availability, design complexity, and the time remaining before the event, and may involve an additional fee.
Delays caused by late measurements, delayed approvals, unanswered messages, unpaid balances, or customer- requested changes may extend the timeline.
11. Changes to an Order
Requested changes to design, color, fabric, measurements, embellishment, embroidery, length, or construction must be submitted as early as possible. Changes after approval or after production has begun are subject to Caribis approval, may increase the price, and may extend the completion date.
Some changes are not possible once fabric has been cut, embroidery has begun, or a production stage has been approved. Any additional charge must be paid before the related work continues.
12. Shipping, Tracking, Duties, and Taxes
Shipping is governed by the Caribis Shipping Policy. Available tracked services may include DHL Express and Nova Poshta (Nova Post), depending on the destination and order. Shipping estimates begin only after the item is complete, fully paid, and dispatched.
The customer is responsible for providing a complete and accurate delivery address and for monitoring tracking, responding to the carrier or customs, and accepting delivery. Additional costs caused by an incorrect address, missed delivery, refusal, or failure to collect may be charged to the customer.
For orders shipped to addresses in the United States, Caribis covers additional import duties and customs- related taxes charged in connection with importation, unless a different arrangement is disclosed and agreed before purchase. For other destinations, import duties, VAT, brokerage fees, and destination charges are generally the customer’s responsibility unless expressly stated otherwise.
13. Returns, Exchanges, and Refunds
Returns and exchanges are governed by the Caribis Returns & Refunds Policy.

Eligible standard-size, non-customized items may be returned or exchanged when the customer contacts Caribis within 14 calendar days after delivery and the item meets all condition and authorization requirements.

Custom-made, made-to-measure, personalized, individually altered, or non-standard items are generally non-returnable and non-exchangeable, except for a confirmed defect, Caribis error, or where applicable law requires otherwise.

Approved refunds are issued to the original payment method after the returned item is received and inspected. Shipping costs and deductions are handled according to the Returns & Refunds Policy.
14. Defective, Damaged, Missing, or Incorrect Items
Please inspect the parcel promptly after delivery. If an item is damaged, defective, incomplete, or different from the confirmed order, contact support@caribis.us as soon as possible with the order number, clear photographs or video, and photographs of the packaging and shipping label.
We may request inspection, return, or carrier documentation. When a claim is confirmed, Caribis will provide an appropriate remedy, which may include repair, alteration, replacement, price adjustment, or refund, depending on the circumstances and applicable law.
15. Cancellations
A ready-to-ship order may be cancelled before dispatch if fulfillment has not progressed too far. Once a parcel has been transferred to the carrier, cancellation is no longer guaranteed and the Returns & Refunds Policy applies.
A custom or made-to-order order may be cancelled only subject to the stage of work completed. Deposits and amounts corresponding to design work, materials, pattern development, labor, and other order-specific costs may be non-refundable once incurred.
16. Billing, Contact, and Account Information
You agree to provide current, complete, and accurate billing, shipping, contact, and account information. You are responsible for maintaining access to the email address and telephone number used for the order and for promptly notifying us of changes.
We may contact you to verify details, request measurements or approvals, resolve payment issues, arrange shipping, or protect against fraud. Failure to respond may delay production or delivery.
17. Intellectual Property
The website and its content, including designs, sketches, photographs, videos, text, graphics, logos, patterns, garment construction concepts, and branding, are owned by or licensed to Caribis and are protected by applicable intellectual property laws.
You may view and use the website for personal, non-commercial shopping purposes. You may not reproduce, copy, distribute, sell, reverse engineer, create derivative products from, or commercially exploit Caribis content or designs without prior written permission.
18. Reviews, Photographs, and Other Submissions
When you submit a review, comment, photograph, video, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights.
Unless a separate agreement states otherwise, you grant Caribis a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, translate, publish, and display voluntarily submitted review content for customer service, website, social media, and marketing purposes. You may contact us to request that customer-provided photographs be removed from future promotional use, subject to content already printed, scheduled, or lawfully archived.
We may moderate or remove unlawful, misleading, abusive, infringing, or irrelevant content. We do not accept confidential design ideas or materials unless we have agreed in writing to treat them as confidential.
19. Third-Party Services and Links
The website may use or link to third-party services such as Shopify, payment processors, PayPal, analytics providers, social networks, marketplaces, carriers, and customs services. We are not responsible for independent third-party websites, systems, availability, or policies.
Use of a third-party service may be subject to that provider’s terms. Complaints concerning a third-party service should be directed to the provider, while concerns about a Caribis order should also be reported to us so we can assist where reasonably possible.
20. Privacy and Payment Security
Personal information submitted through the website is handled according to the Caribis Privacy Policy. Payment information is processed through secure third-party payment providers. Caribis does not intentionally store full payment card numbers on its own website servers.
21. Errors, Inaccuracies, and Corrections
The website may occasionally contain typographical errors, incorrect prices, outdated availability, or inaccuracies relating to descriptions, promotions, shipping, transit times, or product details. We may correct information and update or cancel an affected order when reasonably necessary.
If an accepted order is materially affected by our error, we will contact you and offer an appropriate correction, alternative, or refund of the affected amount.
22. Prohibited Uses
You may not use the website or its content to break any law, infringe intellectual property, harass or discriminate, submit false information, impersonate another person, transmit malicious code, collect personal information without authorization, spam, phish, scrape, bypass security, interfere with the website, or conduct unauthorized resale or commercial exploitation.
We may restrict or terminate access for a serious or repeated violation, without limiting obligations already owed under an accepted order or rights available under applicable law.
23. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the website and its general informational content are provided on an “as available” basis. We do not promise that website access will always be uninterrupted, secure, or error-free.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or mandatory consumer remedies. Subject to those rights, Caribis will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the contract was formed.
Where liability may lawfully be limited, Caribis’s total liability arising from a particular order will not exceed the amount paid for that order, except where applicable law requires a greater remedy.
24. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims suffered by Caribis because of your unlawful use of the website, your infringement of third-party rights, your fraudulent conduct, or your material breach of these Terms. This clause does not apply to ordinary consumer complaints or restrict statutory rights.
25. Force Majeure
Caribis is not responsible for delay or failure caused by events outside reasonable control, including war, civil unrest, natural disaster, epidemic, government action, transport interruption, customs delay, labor disruption, power or communications failure, supplier failure, or material unavailability.
We will make reasonable efforts to communicate material delays and agree on a revised timeline or another appropriate solution. Force majeure does not remove refund or cancellation rights that cannot legally be excluded.
26. Governing Law and Mandatory Consumer Rights
These Terms and separate agreements with Caribis are governed by the laws of Ukraine, without excluding mandatory consumer protections that apply in the customer’s country or place of habitual residence.
Before beginning formal proceedings, the parties should make a reasonable effort to resolve the issue through direct written communication. Nothing in this clause prevents a consumer from using a court, regulator, or dispute process available under mandatory law.
27. Severability, Waiver, and Entire Agreement
If any part of these Terms is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
A delay in enforcing a right is not a waiver of that right. These Terms, together with the Privacy Policy, Payment Policy, Shipping Policy, Returns & Refunds Policy, product listing, order confirmation, and any signed or written custom-order terms, form the agreement relating to your use of the website and purchase.
Where an order-specific written agreement expressly conflicts with these general Terms, the order-specific agreement controls for that order.
28. Changes to These Terms
We may update these Terms by posting a revised version on caribis.us. The version in effect when an order is accepted generally governs that order, unless a later change is required by law or is expressly agreed with the customer.
